18. The Application of Protocol No. 14 to the Convention for the Protection of Human Rights and Fundamental Freedoms

This report concerns the entry into force of Protocol no. 14 to the European Convention on Human Rights (ECHR). The CAVV notes that the primary purpose of this Protocol is to provide the European Court of Human Rights (ECtHR) with instruments it can use to work off its backlog of cases. The CAVV then refers to measures that are crucial to achieving this aim:

  • establishment of single-judge formations;
  • extension of the competence of the committees of three judges; and
  • the introduction of a new admissibility criterion.

In the report the CAVV concludes that a solution must be sought that is confined to the establishment of single-judge formations and the extension of the competence of the committees of three judges. The CAVV then examines how these two measures could be implemented.
